The consensus explanation is straightforward, if troubling: high turnover and staffing cuts at the FDA have left critical functions under strain.
The Official Process vs. Current Reality
In theory, the process for engaging with the FDA at the pre-IND stage is clear, consistent, and tightly regulated. Under formal guidance, pre-IND meetings are classified as Type B meetings within the framework of the Prescription Drug User Fee Act (PDUFA). The agency commits to respond to a sponsor’s meeting request within 21 calendar days, notifying the company whether the request has been granted or denied. If granted, the meeting must be scheduled within 60 calendar days of the original request. Sponsors are also required to submit a complete briefing package — typically at least 30 days before the scheduled meeting — that provides background information on the program, outlines the scientific and regulatory context, and poses clearly framed questions across domains such as nonclinical pharmacology, toxicology, CMC strategy, and early clinical development plans.
The FDA generally provides preliminary written feedback on these briefing materials in advance of the meeting, often a few days beforehand, so that companies can determine whether the live meeting is still needed or whether written responses alone are sufficient. When meetings are held, they are typically one hour in duration and include the FDA review team as well as the sponsor’s development, clinical, and regulatory leads. Inspections — a cornerstone of regulatory oversight — were already under strain during the COVID-19 pandemic, when travel restrictions limited site visits and created a backlog of delayed or deferred inspections. When such individuals depart, the gap cannot be bridged immediately by new staff, no matter how talented. Even with aggressive hiring, it takes months, if not years, for new reviewers to gain the contextual knowledge required to evaluate complex data packages efficiently. During that ramp-up, throughput inevitably suffers.
The downstream effect is a regulatory environment where backlogs compound, timelines stretch, and sponsors shoulder greater uncertainty. For large pharmaceutical companies with dedicated regulatory affairs teams, these delays are an inconvenience; for smaller biotechs with limited cash runways, they can be existential. The FDA’s staffing crisis thus translates directly into heightened risk across the innovation ecosystem, with consequences that ripple from clinical trial sites to investors to patients awaiting new therapies.
Biotech Experiences on the Ground

In Asia, countries such as Singapore, South Korea, and Japan are also courting developers with clearer timelines for clinical trial initiation and, in some cases, more generous incentives for companies willing to conduct first-in-human studies locally.
For emerging companies under intense financial pressure, these international options are no longer theoretical. If the FDA cannot deliver timely feedback, sponsors may choose to initiate trials abroad, then seek U.S. alignment later once programs have matured. That shift carries clear risks, including the challenge of harmonizing trial data across regulatory jurisdictions, but it may be preferable to waiting indefinitely for U.S. guidance. For investors, the calculus is shifting as well: the global spread of innovation means that capital once concentrated in U.S.-based startups may follow development activity overseas.
If this trend accelerates, the United States risks eroding its long-standing leadership in biotech innovation. For decades, the FDA’s combination of rigor and responsiveness has anchored the global ecosystem, ensuring that the earliest and most important clinical milestones occurred on U.S. soil. This not only attracted capital but also fostered clusters of expertise in places like Boston, San Diego, and the Bay Area. With that compact now under strain, there is a real possibility that other regulatory agencies will step into the vacuum, positioning themselves as the new arbiters of early-stage innovation.
The consequences of such a shift would be profound. U.S. patients could face delayed access to cutting-edge therapies if first-in-human data are generated abroad and sponsors delay U.S. filings. The domestic talent pool could fragment as companies look to base operations in jurisdictions more closely aligned with their development timelines. And policymakers would find themselves confronting the loss of both scientific prestige and economic value in a sector that has long been a cornerstone of U.S. competitiveness.
For now, these are early warning signs rather than a full-scale exodus. But the message from industry is clear: if predictability and communication cannot be restored at the FDA, the gravitational pull of global alternatives will only grow stronger.
Policy Implications
The consequences of FDA slowdowns extend far beyond the operational challenges facing individual biotech companies. At stake is the agency’s dual role as both guardian of public safety and facilitator of biomedical innovation. Trade associations and coalitions of biotech CEOs are urging the FDA to publish granular performance metrics on key activities: the proportion of meeting requests granted or denied, the timeliness of responses relative to statutory deadlines, the average lag in inspection scheduling, and the frequency with which review divisions miss PDUFA goal dates. This analysis has focused primarily on the pharmaceutical and biotech industries, but it is important to remember that the FDA’s mandate extends far beyond drugs and biologics. The same staffing shortages and turnover are likely to affect food safety, medical devices, diagnostics, and tobacco regulation. Disruptions in these areas could carry equally serious implications for public health, consumer trust, and U.S. competitiveness, underscoring that the current crisis is not confined to one sector but threatens the agency’s ability to fulfill its full mission.
The danger is that innovation diversity will narrow at precisely the moment when the field most needs breadth. Cell therapies, gene therapies, RNA technologies, and other novel modalities demand a vibrant ecosystem of startups and academic spinouts to explore multiple approaches in parallel. If only the largest players can endure regulatory uncertainty, the pipeline of ideas will shrink, and patients may lose out on potentially transformative treatments.
In this sense, the FDA’s current struggles are not only a matter of bureaucratic efficiency but also of public health policy and economic strategy. Restoring transparency and responsiveness is essential to sustaining U.S. leadership in life sciences and to ensuring that patients continue to benefit from the full diversity of scientific innovation.
A Call for Transparency
The core complaint from biotechs is not simply that the FDA is slow, but that it is silent. In a well-functioning system, a denied pre-IND meeting would at least come with feedback: insufficient data, incomplete questions, or misaligned timing. Instead, some companies are left guessing.
